A passive shareholder may own a company without living in T\u00fcrkiye; a person with a genuine business or commercial connection may be assessed for a short-term residence permit; and an owner who will actively work in the business normally needs a work permit before starting work.<\/p>\n<div style=\"border-left: 4px solid #0b3a82; padding: 14px 18px; margin: 22px 0; background: #f5f8fc;\">\n<p><strong>2026 decision rule:<\/strong> first define what you will actually do, then select the legal status. T\u00fcrkiye\u2019s foreign-direct-investment framework is based on equal treatment: international investors may establish the company forms available under the Turkish Commercial Code and are generally subject to the same formation and share-transfer rules as local investors. The official <a href=\"https:\/\/www.invest.gov.tr\/en\/investmentguide\/pages\/establishing-a-business.aspx\" rel=\"noopener\" target=\"_blank\">Invest in T\u00fcrkiye company-establishment guide<\/a> separately lists a notarised residence permit only where the foreign individual shareholder is already residing in T\u00fcrkiye. Sector-specific ownership, licensing or management restrictions can still apply.<\/p>\n<p>This distinction prevents a common and expensive mistake:<\/p>\n<ul>\n<li><strong>Right to own:<\/strong> your status as shareholder or investor under company law.<\/li>\n<li><strong>Right to stay:<\/strong> your lawful presence under a visa, residence permit, work permit or another recognised status.<\/li>\n<li><strong>Right to work:<\/strong> your authority to perform work under a work permit or a valid exemption.<\/li>\n<\/ul>\n<p>One document does not automatically create the other two. Form the company because it makes commercial sense\u2014not merely because someone has promised that incorporation guarantees residence.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Is_There_a_%E2%80%9CBusiness_Owner_Residence_Permit%E2%80%9D_in_Turkiye\"><\/span>Is There a \u201cBusiness Owner Residence Permit\u201d in T\u00fcrkiye?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>There is no standalone statutory permit named \u201cbusiness owner residence permit.\u201d The closest relevant short-term category is for people <strong>establishing business or commercial connections<\/strong>. The Presidency of Migration Management\u2019s current <a href=\"https:\/\/e-ikamet.goc.gov.tr\/Ikamet\/BasvuruIstenenBelgeler\/BasvuruFormuIstenenBelgeler?tur=0\" rel=\"noopener\" target=\"_blank\">short-term residence document list<\/a> asks for a visa consistent with the purpose of stay and notarised corporate evidence from the person or company to be contacted, including the activity certificate, tax registration certificate, Trade Registry Gazette and authorised-signature list.<\/p>\n<p>That official wording matters. Authorities can look at what the foreigner actually does. Use these practical indicators before choosing a route.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Indicators_of_passive_ownership\"><\/span>Indicators of passive ownership<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>receiving shareholder information and voting on reserved corporate matters;<\/li>\n<li>appointing a properly authorised local manager;<\/li>\n<li>reviewing high-level investment performance without running daily operations; and<\/li>\n<li>visiting for limited shareholder or investor meetings under the appropriate entry rules.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Indicators_of_active_work\"><\/span>Indicators of active work<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>managing staff or daily workflows;<\/li>\n<li>delivering the company\u2019s services or producing its goods;<\/li>\n<li>negotiating or signing operational contracts as the working executive;<\/li>\n<li>selling, consulting, coding, designing or otherwise performing revenue-generating work; and<\/li>\n<li>regularly representing the business as its on-site manager.<\/li>\n<\/ul>\n<p>If the facts fall in the second list, do not rely on a residence card. The Ministry of Labour states that foreigners opening a workplace and working on their own account must complete the establishment steps and then obtain a work permit <strong>before starting work<\/strong>. See the Ministry\u2019s <a href=\"https:\/\/www.csgb.gov.tr\/uigm\/en\/general-information\/conditions-and-process-for-foreigners-to-open-a-company-workplace-in-turkiye\/\" rel=\"noopener\" target=\"_blank\">official company\/workplace process<\/a>.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"2026_Work_Permit_Criteria_for_Foreign_Company_Partners\"><\/span>2026 Work Permit Criteria for Foreign Company Partners<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>For a foreign company partner in a business operating under the balance-sheet method, the Ministry\u2019s current specific criteria state that:<\/p>\n<ul>\n<li>the foreign partner\u2019s own capital share must be at least <strong>TRY 500,000<\/strong>;<\/li>\n<li>the company\u2019s total paid-up capital must be at least <strong>TRY 500,000<\/strong>;<\/li>\n<li>the foreign partner must hold at least <strong>20%<\/strong> of the company; and<\/li>\n<li>the business must employ at least <strong>five Turkish citizens every month from the beginning of the permit\u2019s seventh month<\/strong>.<\/li>\n<\/ul>\n<p>If the foreign partner\u2019s own capital share is at least <strong>USD 100,000<\/strong>, the Ministry says the capital, shareholding and five-employee criteria above do not apply. This is an evaluation-criteria exception\u2014not a guarantee that the permit will be issued. The Ministry may still assess the role, documents, sector, restrictions and international-labour-force policy.<\/p>\n<p>Always verify the live <a href=\"https:\/\/www.csgb.gov.tr\/uigm\/en\/calisma-izni\/calisma-izni-degerlendirme-kriterleri\/\" rel=\"noopener\" target=\"_blank\">Work Permit Evaluation Criteria<\/a> immediately before filing.
